COBRA and the ACA - Your Continuing Legal and Ethical Responsibilities

One hour of Kansas and Missouri ethics credit has been approved. CE credit is only available to 2015 members.

Our speaker, Amy Grace with ERISA Logic LLC, will address the following points:

  • Why COBRA is still relevant and required
  • Temptation to avoid COBRA and steer high cost individuals to the Marketplace
  • The duty to avoid reducing an employee's hours to get them off of the health plan
  • Increased DOL investigations
  • Effect of Supreme Court case

In 2013, the Department of Labor closed 3,677 employee benefit civil investigations. 72.8% of those investigations found violations of ERICA.

ERISA Logic is a benefits-only law firm. It takes the mystery out of employee benefit plan compliance by providing practical solutions and guidance. Amy Grace operates ERISA Logic. She started her employee benefits career as a clerk for the United States Department of Labor – Employee Benefits Security Administration (EBSA).

While at EBSA, Ms. Grace received extensive training on ERISA and COBRA and participated in numerous investigations of retirement plans, welfare plans and third party administrators. Following her time at EBSA, she worked for a national law firm with over 720 attorneys. She focused solely on ERISA plan documentation, administration and compliance.

Ms. Grace formed her own employee benefits practice in 2009. She has been named a Super Lawyers Rising Star in Kansas and Missouri for 2013 and 2014.

Ms. Grace graduated with honors from Missouri State University with a degree in Business Management. She earned her law degree at the University of Missouri at Kansas City.
